
A Chief Magistrates’ Court sitting in Kano on Wednesday sentenced two men, Umar Tijjani and Usman Isa, to 18 months’ imprisonment for trespassing and stealing an iPhone X.
The convicts, who reside in Dorayi Unguwar Bello Quarters and Ja’en Layin Dagaci Quarters in Kano State, were charged with criminal conspiracy, trespass, theft, and mischief.
They were convicted after pleading guilty to all four charges.
Delivering judgment, Chief Magistrate Muttaka Abba-Dandago sentenced each of the convicts to three months’ imprisonment or a fine of N30,000 for conspiracy.
He further sentenced them to six months’ imprisonment each, without the option of a fine, for trespass.
He also sentenced them to another six months’ imprisonment each, without the option of a fine, for theft, along with a fine of N20,000 or an additional three months in prison.
Abba-Dandago further sentenced the convicts to three months’ imprisonment each, without the option of a fine, for mischief, and an additional N30,000 fine or three months’ imprisonment.
The magistrate also ordered them to pay N75,000 each as compensation to the nominal complainant or serve an additional 10 months’ imprisonment in default.
He directed the convicts to sign an undertaking and bond to be of good behaviour and to refrain from committing similar offences after serving their sentences.
Earlier, the prosecutor, Bello Isa, told the court that the defendants committed the offence on July 9 at Ja’en Layin Dagaci, Sharada, Kano.
He said that on the same date, at about 4:00 a.m., the defendants conspired and trespassed into a house located at Ja’en Layin Dagaci, Sharada, Kano, and stole an iPhone X handset.
According to the prosecutor, the offences contravene the provisions of Sections 97, 348, 288, and 327 of the Penal Code.
