Lindsay Clancy is reportedly “very sad” and “scared” as a Massachusetts jury deliberates whether she should be convicted of murdering her three young children or found not criminally responsible because of her mental health. Clancy’s attorney, Kevin Reddington, offered the emotional update while entering the courtroom Friday morning. The jury is now tasked with reviewing weeks of testimony, nearly 80 witnesses and hundreds of exhibits before deciding the 36-year-old’s fate.
5According to AP News, Reddington said Clancy has experienced those emotions since the January 2023 killings. When a reporter asked why she was afraid, he responded: “What would you be scared of?”
Reddington also said he hoped the jury would return with a verdict Friday, although he acknowledged that deliberations could continue much longer. “There are 290-something exhibits, five weeks of testimony,” he said. “It’s obviously a lot of work. They have been very attentive. I don’t know how long it will take them.”
A jury composed of nine women and three men is deciding whether Clancy is guilty of killing her children, 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan. Clancy has pleaded not guilty to three murder charges. Her trial began on July 20, even though her attorneys offered to stipulate that she caused the children’s deaths.
The central dispute is not whether Clancy killed them. The jury must instead determine whether she was legally responsible for her actions at the time.
Jury Requests Knife And Empty Pill Bottles
5Reddington also revealed that jurors asked to examine the knife connected to Clancy’s suicide attempt and bags containing empty prescription bottles. Jurors were shown the bloody knife during the trial. Clancy used it in an attempt to take her life before jumping from a second-floor window, leaving her partially paralyzed.
The defense has also emphasized the number of medications prescribed to Clancy while presenting its argument about her deteriorating mental state.
During Thursday’s closing argument, Reddington held up a bag of empty pill bottles that he said he found inside Clancy’s nightstand. He questioned why police had not collected the bag during their investigation. “I was able to grab this,” he told the jury. “Why wouldn’t the police have grabbed this? You can see they’re all empty. You can see when they were prescribed. You can see what they are. You can see what she took.”
The jury’s request does not reveal what its members think about the evidence or indicate which side they currently favor. However, the knife and medication containers relate directly to the defense’s claims about Clancy’s suicide attempt, treatment and mental condition before the killings.
Postpartum Psychosis Is At The Center Of The Defense
5Clancy’s attorneys argue that she should not be held criminally responsible because she was experiencing postpartum psychosis. In Massachusetts, the lack of criminal responsibility defense is commonly known as the insanity defense. Once the issue is properly raised, prosecutors bear the burden of proving beyond a reasonable doubt that the defendant was criminally responsible.
The defense contends that Clancy was suffering from a mental disease or defect that prevented her from appreciating the wrongfulness of her actions or controlling her behavior.
According to her attorneys, Clancy believed she heard a voice directing her to kill the children so that she could then end her own life. The prosecution has challenged that account and maintains that Clancy knew right from wrong when she killed the children.
Judge William Sullivan told jurors that the verdict slip includes a “not guilty” option in addition to the possible guilty verdicts they are considering.
Retired Judge Says Deliberations Could Take At Least A Week
5Retired Massachusetts Judge Jim Barretto warned that the jury could need at least a week to carefully review the enormous amount of evidence presented during the trial. “They’ve got to get through all of that material,” Barretto said during a live NewsCenter 5 interview. “I don’t envy these jurors. I would not want to be one of them.”
The jury heard five weeks of testimony from nearly 80 witnesses and received more than 300 exhibits. Asked whether he believed prosecutors had met their burden, Barretto said they appeared to be in a strong position overall. However, he identified Clancy’s criminal responsibility as a potential vulnerability in their case.
“I have thought for some time now that the issue of criminal responsibility, they are vulnerable on,” Barretto said. “I think Lindsay Clancy’s defense team has made it a live issue.”
The Alleged Voice Could Be Key To The Verdict
5Both sides called experts who offered conflicting opinions about Clancy’s mental state. The defense presented testimony supporting its position that she was psychotic and unable to control her actions. The prosecution’s rebuttal witnesses disagreed, arguing that she remained capable of making choices and understanding that killing her children was wrong.
Barretto said one prosecution doctor provided jurors with a framework for examining Clancy’s choices and her account of hearing a voice. “When you think of it, that voice is key to this case,” Barretto said.
The reported voice is central to the defense’s argument that Clancy was experiencing postpartum psychosis. Prosecutors, however, questioned the credibility and timing of that account during the trial. Despite offering his analysis, Barretto declined to forecast what the jury would ultimately decide. “I learned a long time ago the hard way not to predict, because you’re wrong over half the time,” he said.
Clancy remains at Tewksbury State Hospital as the jury continues deliberating. There is currently no deadline requiring jurors to reach a verdict.
