Lindsay Clancy Jury Says It Cannot Reach Unanimous Verdict After 18 Hours

The jury deciding Lindsay Clancy’s fate has reported being unable to reach a unanimous verdict after four days of deliberations. Judge William R. Sullivan declined to end the proceedings Tuesday morning and instructed the panel to continue reviewing the extensive evidence presented during the five-week murder trial.

The jury, consisting of nine women and three men, had deliberated for approximately 18 hours before alerting the court to its difficulty reaching an agreement. Clancy has pleaded not guilty to three murder charges in connection with the January 2023 deaths of her children, Cora, 5, Dawson, 3, and Callan, 8 months.

According to the Daily Mail, Sullivan read the jury’s message aloud after bringing the panel back into the Plymouth County Superior Court courtroom. “Members of the jury, I’ve got your question, and the question is, ‘After many hours of deliberation, we are unable to come to a unanimous decision,’” Judge William Sullivan said.

The judge acknowledged the amount of time jurors had already devoted to the case but determined they should continue deliberating. “I brought you back out because I know that this was a long trial, alright. I know that there were over 80 witnesses, there were over 300 exhibits, but because of that I’m going to ask you to go back out, keeping in mind all of the instructions that I gave you, to go out and to continue your deliberations,” Sullivan said.

Jurors are not being sequestered during the deliberation process. The panel must reach a unanimous decision for a verdict to be returned. If jurors ultimately remain unable to agree after further deliberations, Sullivan could declare a mistrial. However, the jury’s note does not automatically mean the case has reached that point. For now, the judge has instructed jurors to keep working.

Clancy’s defense attorney, Kevin Reddington, expressed confidence in the panel before it reported being unable to reach a unanimous decision. Reddington told reporters outside the courthouse Monday that he was “confident in this jury” and that “they’re doing a great job working on the case.” “They’ve been focused and dedicated throughout the whole trial,” he said.

The jury heard five weeks of testimony from medical professionals, psychiatric experts, police officers, friends and members of Clancy’s family. Jurors were also tasked with examining hundreds of exhibits before beginning their deliberations.

Jurors Must Decide Between Three Possible Outcomes

Clancy does not dispute that she killed her three children using exercise bands inside the family’s Duxbury, Massachusetts, home. The central question is whether she was criminally responsible for her actions at the time.

Her defense maintains that Clancy was experiencing postpartum depression and postpartum psychosis after being prescribed multiple psychiatric medications. Her attorneys argue that her mental state prevented her from understanding or controlling her actions.

Prosecutors have acknowledged that Clancy was struggling with mental illness. However, they contend that she remained aware of what she was doing and deliberately planned the killings.

The panel is considering whether Clancy should be found guilty of murder, guilty of manslaughter, or not guilty because she lacked criminal responsibility.

The disagreement reported to Sullivan does not reveal which outcome jurors favor or how closely divided the panel may be.

What Sentence Could Lindsay Clancy Face?

The possible consequences depend entirely on the verdict eventually reached by the jury. If Clancy is convicted of murder, she could receive a sentence of life in prison without the possibility of parole. A manslaughter conviction carries a potential maximum sentence of 20 years in prison.

If jurors find Clancy not guilty due to a lack of criminal responsibility, she would not simply be released from custody. She would instead face further court proceedings concerning psychiatric evaluation, treatment and possible commitment to a state mental health facility.

The jury cannot return any of those verdicts unless all 12 members agree.

A Mistrial Would Not End The Criminal Case

If further deliberations fail to produce a unanimous decision, Sullivan may eventually determine that the jury is hopelessly deadlocked and declare a mistrial.

A mistrial would not amount to an acquittal or establish Clancy’s innocence. It would end the current trial without resolving the three charges against her.

Prosecutors could then decide whether to bring the case before a new jury, although no such decision is currently necessary because deliberations remain underway.
