The possibility of a second Lindsay Clancy murder trial remains unresolved after jurors failed to reach a unanimous verdict on whether she was criminally responsible for killing her three children. Shortly after Judge William Sullivan declared a mistrial Friday, Plymouth County District Attorney Timothy J. Cruz addressed reporters outside the courthouse and placed the focus back on Cora, Dawson and Callan Clancy. Although Cruz strongly defended the decision to prosecute the case, he stopped short of confirming whether his office would put Clancy on trial again.

Cruz described the Clancy case as being about the “cruel, calculated killings of three innocents” while speaking from a podium outside Plymouth Superior Court. He acknowledged the emotional impact the trial had on the children’s family, the Duxbury community, members of the media, and everyone involved in the proceedings. “This was an emotional trial for everybody, the Duxbury community, members of the media,” Cruz said.

The district attorney also recognized prosecutors Jennifer Sprague and Shanan Buckingham, pointing out that they are “both mothers themselves.”

Sprague and Buckingham spent weeks arguing that Clancy understood the nature and wrongfulness of her actions when she strangled her three children in the family’s Duxbury home on January 24, 2023. The defense maintained that Clancy was experiencing postpartum psychosis and should not be held criminally responsible.

Timothy Cruz Refocuses Attention On The Children

The mistrial ended the lengthy proceedings without answering the central legal question surrounding Clancy’s mental state.

Cruz emphasized that the prosecution had always been focused on obtaining justice for the three children whose deaths brought everyone to the courthouse. “I bring it all back to the child victims in this case… this was and has always been about getting justice for those three little babies,” he said. “We are here at this courthouse today because those children are not.”

Clancy was charged with three counts of first-degree murder in the deaths of five-year-old Cora, three-year-old Dawson and eight-month-old Callan. She does not dispute killing the children. Her attorneys argued that her severe mental illness meant she could not understand the wrongfulness of her actions or conform her conduct to the law.

Prosecutors presented a sharply different account, alleging that Clancy deliberately created an opportunity to be alone with the children and carried out the killings while her then-husband, Patrick Clancy, was collecting medicine and dinner.

Prosecutors Have Not Decided Whether To Retry Lindsay Clancy

Despite his forceful remarks about the case, Cruz said his office had not determined whether it would pursue a second murder trial. “No decisions will be made today,” he told reporters. The district attorney explained that the issue would be addressed during forthcoming court proceedings.

A mistrial resulting from a deadlocked jury does not dismiss the charges or prevent prosecutors from retrying Clancy. The case instead returns to an unresolved status, leaving the district attorney’s office with several possible paths.

Prosecutors may seek another trial with a new jury, negotiate a plea agreement with the defense, or decide not to continue pursuing the charges. According to the Associated Press, Clancy’s defense may also ask the judge to enter a judgment of acquittal, although the prosecution would have an opportunity to oppose that request.

Jury’s Precise Division Remains Unclear

Questions have continued to surround the jury’s reported division, particularly after Clancy’s attorneys suggested that one male juror stood between the panel and a verdict finding her not criminally responsible.

When Cruz was asked whether a second jury could be convinced of Clancy’s guilt if 11 of the original 12 jurors allegedly disagreed, he cautioned against assuming how anyone voted. “We don’t know what they believed or didn’t believe,” Cruz said.

The jury told Sullivan three separate times that it could not reach a unanimous decision. However, jurors were not formally polled about their individual positions, and their private deliberations have not been publicly disclosed.

A note from the jury foreperson indicated that one juror had allegedly acknowledged doubt but refused to apply it to the verdict. Defense attorney Kevin Reddington repeatedly sought the juror’s removal, but Sullivan declined after determining there was not enough evidence that the panelist had refused to follow the law.

That disagreement intensified before the mistrial. Reddington pursued a last-minute emergency appeal in an attempt to stop Sullivan from dismissing the jury, but the request was denied by Massachusetts’ highest court.

Lindsay Clancy Will Return To Court Later This Month

Clancy is scheduled to return to court on September 29 at 9 a.m. During that hearing, Sullivan is expected to consider a post-trial motion from the defense and discuss what happens next, including the possibility of setting a date for another trial.
