Kim Zolciak‘s family drama has taken a much darker turn.

The case has taken a new turn, with growing questions over the 15-year-old’s future, his age, and whether he will remain under the juvenile system as the allegations continue through court.

The case reportedly dates back to April, when a female classmate accused KJ of sexually assaulting her at a gym. An investigation followed for months before Kim Zolciak’s 15-year-old son was arrested on August 17 and later indicted on seven felony charges, putting his age and legal status at the center of the case.

Kim Zolciak’s teenage son KJ Biermann is facing an increasingly complicated legal battle after prosecutors raised fresh concerns about his past while he remains jailed over separate allegations.

The 15-year-old was arrested on August 17 and later indicted on seven felony charges connected to an alleged encounter with a female classmate at a Georgia gym in April. He has denied the allegations, while his attorney continues fighting to keep the case within the juvenile justice system.

That fight has now become even more complicated, with prosecutors pointing to an earlier juvenile matter that had remained out of the public eye. The revelation has added another layer to a case already putting KJ’s age, future and potential punishment under intense scrutiny.

Prosecutors Say An Earlier Case Was Kept Behind Closed Doors

The latest development came during Friday’s bond hearing, when Deputy District Attorney Caitlin McGillicuddy claimed investigators had discovered videos on KJ’s phone connected to an earlier sexual incident involving a family member who was under 12.

She also said the teenager had previously faced a sexual-battery charge in juvenile court and had been under court supervision since October 2025. According to The Daily Mail, the prosecutor characterized the earlier matter as serious and said it marked a second sexual offense involving a female victim.

The details had not previously been public because the case was handled through Fulton County Juvenile Court. KJ’s attorney Jason Sheffield strongly disputed that characterization, telling the news outlet that the prior matter involved inappropriate behavior between two middle-schoolers.

He insisted that the issue did not result in an adjudication for statutory rape, sexual intercourse, or a comparable offense. His response now puts the sharply different accounts at the center of an already closely watched legal battle.

The Estranged Couple Put Their Differences Aside For Their Son

Zolciak and Biermann have spent years locked in a bitter divorce battle, but their son’s legal troubles appear to have pushed those differences to the side, at least for the moment.

The estranged couple showed up at KJ’s bond hearing on Friday to support their 15-year-old son, marking one of the rare occasions they have been seen together since their separation.

Although they arrived separately and kept their distance in court, their shared presence sent a clear message that their son’s situation had taken priority.

As reported by The Blast, the former couple did not interact during the hearing, with Zolciak sitting beside their daughter Brielle while Kroy stayed in a separate row. Still, showing up for KJ together was a rare show of unity from a couple whose relationship has been anything but united in recent years.

His Legal Team Is Also Fighting To Keep The Case Out Of The Spotlight

KJ’s legal battle is not only about where he will be tried, but also how much of the case becomes public while he is still a teenager. His attorneys have raised concerns about the intense media attention surrounding the allegations and want greater privacy for both KJ and the other minor involved.

The defense has pointed to the 15-year-old’s life outside the courtroom, emphasizing his strong academic record, athletic achievements, and scholarships as evidence that he has remained engaged in school and his community, The Blast reported.

His lawyers also stressed that he has not attempted to flee or avoid authorities since learning about the allegations. The legal team has further highlighted KJ’s willingness to cooperate, including his submission to a polygraph test as part of his effort to maintain his innocence.

With his age now central to nearly every major decision in the case, the defense is pushing for an approach that protects his future while the allegations are resolved.

Kim Zolciak’s Son Could Face A Strict New Reality If Released

The push to keep KJ’s case private is only part of the battle. Even outside the courtroom spotlight, his life could look very different if he is released while the case continues.

Former prosecutor Lindsay Richards said the teenager could face “close monitoring,” potentially including GPS tracking, house arrest, and homeschooling. She also said therapy and court-ordered educational programs could be among the conditions attached to his release.

For Zolciak, that could mean taking on a much bigger role in managing her son’s day-to-day life while his legal fight unfolds. With his attorneys also battling to keep him in the juvenile system, getting KJ home may be only the beginning of another difficult phase.

Could Kim Zolciak’s biggest challenge now be helping her son navigate life under restrictions while his future remains uncertain?
